Notice of Violation and Civil Penalty Process

If you receive a Notice of Violation (NOV) or a Civil Penalty, you must comply with the requirements in the Notice.  If you receive a Civil Penalty, payment should be submitted within 10 days payable to Knox County Trustee and mailed to Knox County Stormwater Management 205 West Baxter Avenue, Knoxville, TN 37917.

If you do not respond to a notice containing a Civil Penalty within 10 days, any civil penalty will be considered final. Knox County may apply to the appropriate chancery court for a judgment and seek execution of such judgment.  The court, in such proceedings, shall treat the failure to appeal the civil penalty as a confession of judgment.  This Civil Penalty does not relieve you of your responsibility to become fully compliant with Knox County’s Stormwater Ordinance.

If you feel you have received the NOV or the Civil Penalty in error, you may appeal the decision. If you would like to appeal a Civil Penalty, you may request a meeting. The appeal request must be made in writing and received by the County within ten (10) business days after the date of the notice.  All appeal requests should be mailed to Knox County Stormwater Management at 205 West Baxter Avenue, Knoxville, TN 37917.

Under Section 16 of Ordinance for Stormwater Management, O-07-12-101, enforcement mechanisms include:

Notice of Violation

Compliance Order

Withholding of a Certificate of Occupancy

Stop Work Order

Withholding of a Permit (Building permits included)

Civil Penalty (up to $5,000 per day of violation)

Compliance Meeting

Withholding of Permit Inspections (Building Permits included)

Recovery of Damages and Costs
